Terms of Service

These Terms are an agreement between you and Watch&Cie (“we”, “us”) governing your use of watchcie.com and our related services (the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. What Watch&Cie is — and is not

Watch&Cie is a price-comparison and information service. We collect publicly available watch listings from independent dealers and marketplaces, organise them by brand, model and reference, and show you where a watch is offered and at what price.

We are an intermediary only. We are not a seller, buyer, agent, broker, auctioneer, escrow agent, appraiser or payment processor, and we are not a party to any transaction between you and a dealer.

  • Every purchase happens on the dealer’s own site under their terms, prices, taxes, shipping and returns. Your contract is with the dealer, not with us.
  • We do not hold, inspect, value or authenticate any watch. Descriptions, photographs, condition, box-and-papers claims and authenticity are the dealer’s responsibility.
  • We do not vet dealers. A dealer appearing here is not an endorsement.
  • Listings and prices are shown as last collected and may already be sold, repriced or withdrawn. Currency conversions are indicative and not binding.
  • When you click through to a dealer you leave the Service, and their terms and privacy policy apply. We are not responsible for their content, products or conduct.

2. Affiliate links

The Service is free to you. Some links to dealers are, or may become, affiliate links: if you buy after clicking one, we may earn a commission at no additional cost to you.

Commercial relationships do not change a dealer’s ranking or displayed price in our default results. Anything paid, promoted or sponsored is labelled as such.

3. Prices and market data

Figures such as “retail price”, “average sold price”, “price history”, “estimated value” or “deal score” are estimates compiled from public sources and our own data. They are not appraisals, valuations, or financial, investment, tax or insurance advice, and they are not a guarantee of what any watch will sell for.

Do not rely on them as the sole basis for a purchase, sale, insurance or investment decision.

4. Eligibility and your account

You must be at least 16, or older where your local law requires. We do not knowingly collect data from anyone younger and will delete such accounts.

  • You are responsible for keeping your credentials confidential and for activity under your account. Tell us at stevelee@watchcie.com if you suspect unauthorised access.
  • Information you give us must be accurate.
  • Your public nickname (2–20 characters; letters, numbers, underscores, periods) must not impersonate another person, brand or dealer, contain hateful, sexual or deceptive content, or infringe anyone’s rights. We may reclaim a nickname that breaks these rules.
  • Do not sell or transfer your account, or create a new one to evade a suspension. Accounts are for people, not automated agents.

5. Dealers and data sources

Dealers do not hold accounts and have no contractual relationship with us unless we have signed a separate agreement.

We collect listing information — brand, model, reference, condition, price, availability — from publicly accessible dealer sites, marketplaces and data feeds. Listings identify their source and link to the original page.

Dealers: to have a listing corrected, attributed differently or removed, email stevelee@watchcie.com with the relevant URLs.

6. Alerts and email

You can save watches and request price alerts, and opt in to our newsletter (unsubscribe link in every email).

Alerts are best-effort. We do not guarantee that you will be notified of every change, that a notification will be accurate, or that it will arrive in time to act. We are not liable for a missed alert or purchase opportunity.

7. Your content

You keep ownership of what you post (“User Content”). You grant us a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence — sublicensable only to our service providers and platforms where we promote the Service — to host, store, cache, reproduce, adapt for format and size, publish, display and distribute it in order to operate and promote the Service. This ends when you delete the content or your account, except for copies already cached, distributed or used in published marketing.

You are responsible for what you post and confirm you hold the rights to it. Do not post content that:

  • infringes copyright, trademark or other rights, including photographs you did not take;
  • promotes counterfeit, replica or “homage-as-genuine” watches or stolen goods, or misrepresents a watch’s authenticity, originality, condition or provenance;
  • offers an item for sale or solicits a transaction — this is a comparison and community service, not a marketplace;
  • is unlawful, hateful, harassing, threatening, sexual, violent or deceptive;
  • is spam or unsolicited advertising;
  • contains another person’s personal data without permission.

We may remove content or restrict accounts that break these rules, with reasons, unless we are legally prevented or the content is manifestly illegal. We do not pre-screen User Content and are not responsible for what others post.

8. Counterfeits and stolen watches

Prohibited: posting, advertising or linking to counterfeit or replica watches, counterfeit parts, or forged papers or certificates; presenting a watch as original when it has aftermarket parts, a service dial, a redial or an undisclosed replacement component; posting about a watch you know or suspect to be stolen, other than to report it.

We will remove offending content and accounts, may retain records, and may report to authorities or the brand. Accounts that repeatedly breach this Section or Section 9 will be terminated.

To report a listing you believe is counterfeit or stolen, email stevelee@watchcie.com with the URL and the basis for your belief.

9. Copyright complaints

If you own rights in material shown here and believe it is used without permission, email stevelee@watchcie.com with:

  1. your name, address, telephone number and email;
  2. the work you say is infringed;
  3. the URL(s) to be removed;
  4. a statement that you believe in good faith the use is not authorised;
  5. a statement that the notice is accurate and, under penalty of perjury, that you are the rights holder or authorised to act for them;
  6. your signature, physical or electronic.

We will remove material subject to a valid notice and notify whoever posted it. They may send a counter-notice with items 1, 3 and 6, plus a statement under penalty of perjury that the removal was a mistake or misidentification and consent to the jurisdiction in Section 16. We may restore the material after 10–14 business days unless the complainant confirms they have filed suit.

10. Acceptable use

Do not:

  • scrape, crawl, harvest or bulk-download the Service or its data, or use bots or automated means, except through interfaces we provide or as permitted by our robots.txt;
  • use the Service or its data to train, fine-tune or evaluate any machine-learning or AI model, or to build any competing dataset, product or service;
  • resell, sublicense or commercially redistribute our listings, price histories, statistics or database, in whole or in substantial part, without our written permission;
  • reverse engineer, probe, load-test or interfere with the Service or its infrastructure, or circumvent rate limits, authentication or access controls;
  • send unsolicited messages, harvest information about other users, or impersonate anyone;
  • use the Service unlawfully or in breach of sanctions or export-control law.

We may rate-limit, block or terminate access we reasonably believe breaches this Section.

11. Intellectual property

The Service — its design, interface, software, text, graphics, compiled data, our derived statistics, and the selection and arrangement of our database — belongs to Watch&Cie or its licensors and is protected by copyright, database rights (including the EU sui generis database right) and trademark law. We reserve all rights not expressly granted, and give you a limited, personal, revocable, non-transferable licence to use the Service for your own non-commercial purposes.

“Watch&Cie” and our logo are trademarks or pending applications of Watch&Cie. Dealer photographs and descriptions belong to the dealers. Watch brand names, logos, model names and reference numbers are trademarks of their owners, used here descriptively to identify the watches being compared. Watch&Cie is independent and is not affiliated with, authorised by or endorsed by any watch manufacturer, dealer or marketplace.

If you send us ideas or feedback, we may use them for any purpose without obligation or compensation. Do not send us anything confidential.

12. Availability

The Service is free and under active development. We may add, change, suspend or discontinue any part of it at any time. We do not promise uninterrupted availability or indefinite retention of data.

13. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, and we disclaim all warranties, express, implied or statutory, including accuracy, completeness, timeliness, merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that any listing is genuine, available, correctly priced or lawfully offered; that any dealer is reputable or solvent; that price data is accurate; or that the Service will be uninterrupted or error-free.

This does not limit consumer rights that cannot be limited under the law where you live.

14. Limitation of liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, goodwill or anticipated savings.
  • We are not liable for any loss arising from a transaction with a dealer or other third party found through the Service, including non-delivery, misdescription, counterfeit goods, fraud, customs issues or a dealer’s insolvency.
  • Our total liability for all claims is limited to the greater of what you paid us in the preceding twelve months — currently nil, as the Service is free — and USD 100.

Nothing here excludes our liability for death or personal injury caused by our negligence, fraud, gross negligence or wilful misconduct, or any liability that cannot lawfully be excluded, including mandatory consumer rights where you live.

15. Indemnity, suspension and termination

If you use the Service as a business, you will indemnify Watch&Cie and its operator against claims, losses and reasonable legal fees arising from your User Content, your breach of these Terms or your misuse of the Service. If you use it as a consumer, this applies only as far as your local law permits and only for loss caused by your intentional or grossly negligent breach.

You may ask us to delete your account at any time by emailing stevelee@watchcie.com. We may suspend or terminate access for breach of these Terms, legal or security risk, legal requirement, or discontinuation of the Service — with notice, reasons and a route to appeal, except where we are legally prevented or the breach is serious and obvious.

Sections 1, 2, 3, 7 (as to licences already granted), 11, 13, 14, 15, 16 and 17 survive termination.

16. Governing law and your consumer rights

These Terms are governed by the laws of the Republic of Korea, and the courts of the Republic of Korea have exclusive jurisdiction.

This does not deprive you of mandatory consumer-protection rights in your country of residence, or of the right to bring proceedings in your local courts where that law gives you that right.

Please contact us at stevelee@watchcie.com before filing a claim — most issues are resolved quickly.

17. General

  • Changes. We may update these Terms and will notify you on the Service or by email before a material change takes effect. Continued use means acceptance.
  • Assignment. You may not assign these Terms. We may assign them to a successor, including on incorporation of the operator or a sale of the business, on notice to you.
  • Severability. An unenforceable provision is modified to the minimum extent necessary or severed; the rest stands.
  • No waiver. Not enforcing a provision is not a waiver of it.
  • Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control, including outages at our providers.
  • No agency. Nothing here creates a partnership, joint venture, employment or agency relationship.
  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between us regarding the Service.
  • Notices. We may notify you by email or on the Service. Notices to us go to stevelee@watchcie.com.
  • Language. If a translation conflicts with the English version, the English version prevails, except where your local law requires otherwise.
